Accidents at work are also called occupational accidents. Typically, these can be quite serious accidents which can involve heavy machinery, forklifts, loading trucks, agricultural machinery and the operation of equipment which can lead to serious injury. Other accidents can occur at work which are slip and fall type accidents and which can arise from inadequate supervision of the workplace.
By their very nature, occupational injuries can be serious and can lead to long term injuries. Depending on the injury, the person may not be in a position to continue in their employment following the accident and this can give rise to a loss of earnings claim into the future if that person is not in a position to find alternative suitable employment. In cases like these, the awards made by the Courts can be significant.
The record of Irish Employers in terms of Health and Safety is quite poor. As a result of this, occupational injuries are common and reports in the newspapers of occupational injuries and accidents at work, including fatal accidents, are unfortunately all too common. These events are hugely traumatic for Clients and we are in a position to offer a Client some comfort by advising them in terms of their rights when such an accident occurs. Typically, a Client must prove negligence on the part of an employer and if it is the case that the employer has failed to provide a safe place of work, then it would normally follow that the employer was therefore negligent. A key part of any claim against an employer is whether or not the employer has furnished the Client with any Health & Safety Training and again, the record of Irish Employers in this regard would be quite poor. The simple fact remains, however, if you have had an accident at work, and the accident is not your fault, then you may well have a cause of action against your employer.
We at Gartlan Winters are happy to advise any Client or potential Client in relation to an accident at work in order to ascertain and advise them as to whether they might have a potential action against their employer.
