Car Accidents

The most common form of car accident, which gives rise to an Application to the Injuries Board or to Court Proceedings, is an accident involving mechanical vehicles ie, cars, buses, lorries, motorbikes etc.

If you are a driver or a passenger in a vehicle which has been collided with by another vehicle or a cyclist which has been collided with by a vehicle and the accident was not your fault, then you have an action against the owner and/or driver of the other vehicle.

If you have sustained personal injury as a result of the accident, then you are entitled to bring a claim against the driver of the other vehicle.

The most common type of road traffic accident is an accident where the vehicle in which you are a passenger or driver has been rear-ended by another vehicle. For the most part, Insurance Companies accept liability in relation to these accidents and consent to an Assessment of your claim before the Injuries Board.

Other common types of accident which occur and where liability is not normally disputed are accidents where the other vehicle breaks a red light or fails to stop or yield.

The common type of injury which arises out of motor vehicle accidents are for the most part soft tissue which result in neck and back injuries which are diagnosed by either an Accident & Emergency Consultant or by the Client’s GP. In more serious cases, however, the injuries can be fatal, lift threatening or result in a disability.

From our experience of dealing with many many road traffic accidents over the years on behalf of Clients, we are normally in a position to advise a Client at a first consultation how any claim might progress and be dealt with and how the Insurance Company for the other vehicle is likely to deal with same. The majority of road traffic accidents are dealt with before the Injuries Board, with the Injuries Board assessing the injuries and confirming the appropriate level of compensation for the pain and suffering occasioned to the Client. In certain cases, however, where there is a dispute in relation to how an accident occurred, or where the injuries are particularly significant, it may be necessary for the matter to go to Court.
